Judge convicts former Postalis and Petros directors of embezzling debt purchases


The federal court of Rio de Janeiro sentenced the former president of Postalis, the Correios pension fund, Alexej Predtechensky, and the fund’s former director of investments, Adilson Florêncio da Costa, in Operation Recomeço, launched in 2016. can appeal.

Another 12 people were convicted in the same trial. The lawsuit concerns the purchase of Grupo Galileo bonds by the pension funds Correios and Petrobras. Lava Jato in Rio stated in the complaint that resources that should have been used to restore Universidade Gama Filho were diverted. According to the public prosecutor’s office, the damage amounts to R$ 89 million. The scheme was also studied at the Post Office CPI.

Businessman Ricardo Magro, owner of the Manguinhos refinery, was acquitted in the lawsuit. He was even arrested during the investigation and accused by the federal administrative authority of having been involved in the issuance of the bonds.

The verdict is signed by Judge Adriana Alves dos Santos Cruz of the 5th Federal Criminal Court of Rio de Janeiro, who has sufficient evidence that the bonds were issued without ballast and that the operation was “tailor-made” so that the purchase through annuity funds was feasible.

“In practice, it was a loan granted by pension funds with no guarantee of repayment. The importance of a corporate guarantee is that it can be enforced in the event of a default. In the case of the files, the specific design of the process has meant that in the event of non-payment, the supposed guarantees have fizzled out with the transaction itself,” says an excerpt of the judgment.

3) Carlos Alberto Peregrino da Silva (former director of the Galileo Group): 5 years and 6 months in prison for issuing, offering or dealing in bonds or securities without sufficient ballast or guarantee;

4) Paulo Cesar Prado Ferreira da Gama (then legal representative of the Universidade Gama Filho): 4 years and 6 months in prison for issuing, offering or dealing in securities without sufficient cover or guarantee;

5) Luiz Alfredo da Gama Botafogo Muniz (then legal representative of the Universidade Gama Filho): 4 years and 6 months in prison for issuing, offering or dealing in bonds or securities without sufficient ballast or guarantee;

6) Alexei Predtechensky (former President of Postalis): 5 years imprisonment for fraudulent management of a financial institution;

7) Adilson Florêncio da Costa (former Finance Director of Postalis): 5 years imprisonment for fraudulent management of a financial institution;

8) Ricardo Oliveira Azevedo (former Finance Director of Postalis): 5 years imprisonment for fraudulent management of a financial institution;

9) José Carlos Rodrigues Sousa (then a member of Postalis’ investment committee): 5 years in prison for fraudulent management of a financial institution;

10) Mônica Christina Caldeira Nunes (then a member of Postalis’ investment committee): 5 years in prison for fraudulent management of a financial institution;

11) Carlos Fernando Costa (former President of Petros): 4 years and 6 months in prison for fraudulently running a financial institution;

12) Luiz Carlos Fernandes Afonso (former President of Petros): 4 years and 6 months in prison for fraudulently running a financial institution;

13) Newton Carneiro da Cunha (former director of Petros): 4 years and 6 months in prison for fraudulent management of a financial institution;

14) Maurício França Rubem (former director of Petros): 4 years and 6 months in prison for fraudulent management of a financial institution.
